Who Needs HIPAA Training?

A question asked by many organizations is, “How do I know who needs training and what course to take?”

To determine which employees in your organization require HIPAA training, it is important to understand Protected Health Information (PHI) and the role your employees have in relation to it.  The function of each employee will determine the type of HIPAA training they will require.

Protected Health Information

The first concept to understand is “PHI.” The Privacy Rule protects all “individually identifiable health information” held or transmitted by a covered entity or its business associate, in any form or media, whether electronic, paper, or oral. The Privacy Rule calls this information “Protected Health Information.”

“Individually identifiable health information” is information that relates to:

the individual’s past, present or future, physical or mental health or condition. It may describe the provision of health care to the individual. This information may address past, present, or future payment for health care to the individual. It also identifies the individual or there is a reasonable basis to believe it can be used to identify the individual.

If your members access, use or disclose PHI in any form, they will require some type of HIPAA Training. Members include volunteers, students, and contractors, if any in your organization who may encounter Protected Health Information.

HIPAA Training Based on Job Function:

Next consider the job function of your employees. This will allow you to decide on the type of training they need.

There are several types of training based on function:

Why HIPAA Training is Important

The Office for Civil Rights has guidelines for HIPAA training.

  • A covered entity or business associate must train all members of its workforce on the policies and procedures with respect to protected health information required by HIPAA as necessary and appropriate for the members of the workforce to carry out their functions within the organization.
  • A covered entity or business associate must train each new member of the workforce within a reasonable period after the person joins the organization.
  • It must train each member of the covered entity’s or business associate’s workforce if there are changes in the policies or procedures of HIPAA, within a reasonable period after the material change becomes effective.
